1. The agreement

These terms are between Tunasim Farms (“Tunasim”, “we”) and the farm or business (“the farm”, “you”) whose admin accepts them in the app. The person who accepts confirms they may do so for the farm. The Privacy Notice explains what data the app handles; it is part of this agreement. If these terms change in a way that matters, an admin will be asked to accept the new version at their next sign-in, and we will email admins about it beforehand where we can.

2. The service

TunasimCare is a web app and phone app for keeping farm records: people, tasks, stock, harvests, sensors, forms and compliance, with optional AI suggestions. We aim to keep it available at all times but do not promise uninterrupted service; we will tell admins about planned maintenance. We may improve or change features; we will not remove a feature the farm depends on without notice.

3. Accounts and people

The farm's admins create logins for the farm's staff and decide each person's role. Each person is responsible for keeping their password private and for what is done under their login. The farm must tell us promptly if a login is lost or misused. Accounts are for people who work with or for the farm; buyers may be given access to the farm's customer portal only.

4. What the farm is responsible for

• The accuracy of the records the farm enters, and decisions made from them. TunasimCare helps you keep records; it does not replace your own checks, your agronomist, or the certification body.
• Telling your staff that their work is recorded in TunasimCare and what for, and recording sensitive information (such as medical notes) only where the law allows and, where required, with the person's agreement.
• Complying with laws that apply to the farm, including Ghana's Data Protection Act, 2012 (Act 843) — which may require the farm, as a data controller, to register with the Data Protection Commission.
• Using the app lawfully: no attempts to reach another farm's data, to break the service, or to upload unlawful content.

5. How we handle the farm's data

This section is our data-processing agreement with the farm.

• The farm owns its data. The farm is the data controller; Tunasim is the processor. We process the farm's data only to provide the service, on the farm's instructions as given through the app and these terms, and as the law requires.
• Confidentiality. Our people who can reach the farm's data are bound to keep it confidential and reach it only to support, secure or improve the service.
• Security. We keep technical and organisational safeguards: encrypted transport and storage, each farm's records kept apart, role-based access, and logs. We will tell the farm without undue delay if we become aware of a breach affecting its data, with what we know, so the farm can meet its own duties.
• Sub-processors. We use the providers named in the Privacy Notice (Supabase, Vercel, Google Gemini, Microsoft Azure, Resend, OpenWeather, MapTiler, Esri, and Apple and Google for notifications). We will give admins 30 days' notice by email before adding a provider that will hold personal data; a farm that objects may end the agreement under section 8.
• Where. The database is hosted in the United States; see the Privacy Notice.
• Help with rights. We will help the farm answer a person's request to see, correct or delete their data where the farm cannot do it in the app.
• Return and deletion. While the agreement runs, the farm can export its records from the app. When it ends, the farm has 30 days to export; we then delete the farm's data, except copies in backups (which expire within 90 days) and anything we must keep by law.

6. AI features

Plant diagnosis, label reading, the assistant and the daily briefing use third-party AI models, named in the Privacy Notice. Their output is a suggestion for a person to check. Photos go to the diagnosis model only when a person presses Diagnose after agreeing to it. We use business tiers under which the providers state they do not train on your data.

7. Fees and fair use

Any fees, allowances (such as AI calls, storage and emails per day) and payment terms are those agreed with the farm in writing. Where a farm exceeds its allowance the affected feature pauses until the allowance resets or is raised; records are never lost because of an allowance.

8. Ending the agreement

The farm may stop using TunasimCare at any time by telling us. We may suspend or end a farm's access for non-payment, for a serious breach of these terms, or if the law requires, giving notice where we reasonably can. Section 5's return-and-deletion terms apply whichever side ends it.

9. Liability

We provide the service with reasonable skill and care. We are not liable for loss caused by inaccurate records the farm entered, by decisions made from AI suggestions without checking, by the farm's own breach of these terms, or by events outside our reasonable control. Nothing in these terms limits liability that the law does not allow to be limited. Otherwise, our total liability to the farm in any twelve months is limited to the fees the farm paid us in that period.

10. General

These terms are governed by the laws of Ghana and its courts. If part of these terms cannot be enforced, the rest still applies. Questions: contact.farms@tunasim.com.
